The United Kingdom is an old and strong power in the area of shipping by seaand also the world’s marine insurance center. In its marine insurance practice, marineinsurance brokers play a significant role. The British legal system of marine insurancebrokerage has experienced long term development and become relatively mature. Thepresent legal system imposes full range of supervision and provides detailed rules onthe position, rights and obligations of marine insurance brokers. In addition, theBritish legal system of marine insurance brokerage always influences other countries’relevant rules because of the United Kingdom’s position as the world’s marineinsurance center.As a country with prosperous business in shipping by sea and in the wake ofinternational trade development, China began to establish the legal system of marineinsurance brokerage. However, the Chinese legal system of marine insurancebrokerage is currently at a preliminary stage, and does not impose full and strongsupervision or provide well-developed rules on the position, rights and obligations ofmarine insurance brokers. Although many valuable attempts have been made inlearning from the British legal system of marine insurance brokerage, somenoteworthy aspects of the British rules are possibly overlooked.The thesis is to tentatively analysize the British legal system of marine insurancebrokerage, find some valuable points to be referred to in the improvement of Chineselegal system of marine insurance brokerage and provide some suggestions for suchimprovement. The paper has five chapters: Chapter One is to generally review the history and present status of the British legal system of marine insurance brokerage,Chapter Two to Chapter Four are to take a detailed research on the British legalsystem of marine insurance brokerage and what China could learn from the Britishlegal system of marine insurance brokerage. Chapter Five is to analysize andemphasize the significance of improving the Chinese legal system of marineinsurance brokerage.Chapter One is to generally review the history and present status of the Britishlegal system of marine insurance brokerage. Firstly the history of the British legalsystem of marine insurance brokerage is explored. Secondly the present British legalsystem of marine insurance brokerage is generally reviewed.Chapter Two is to analysize the supervision structure of the British legal systemof marine insurance brokerage.Chapter Three is to discuss the position of British marine insurance brokers.Chapter Four is to illustrate the detailed rules in the United Kingdom on therights and obligations of marine insurance brokers.Chapter Two to Chapter Four try to respectively introduce specific aspects of theBritish legal system of marine insurance brokerage (including the supervisionstructure in whole and two key legal aspects: the position of marine insurance brokers,and the rights and obligations of marine insurance brokers), find some valuable pointsfrom them, consider the relevant problems in the current Chinese legal system ofmarine insurance brokerage, and provide some suggestions for the improvement ofthe Chinese legal system in this regard.Chapter Five is to analysize and emphasize the significance of improving theChinese legal system of marine insurance brokerage.
