| For administrative management, Vietnam pays attention to construct and gradually completes the system of legal documents on management, use, and exploitation of resources from land. More than60years since President Ho made Land Ordinance, the system of legal documents on land has been completed gradually. The State previously managed land only by legally valid documents such as Government decrees, Ministry’s circulars,1993Law on Land is now amended, completed and replaced by2003Law on Land.Law in general and law on land in particular are a tool for state administrative management. However, state administrative management is an operating process which is being completed in terms of land policies, management mechanism, form, method and objectives of management in certain periods. Therefore, law on administration management of land in general and land lease in particular needs to be completed as a field of law.Successes in use and exploitation of advantages of land in foreign direct investment are being improved and developed. However, the use of land in foreign investment in Vietnam reveals many inadequate issues affecting performance of foreign direct investment enterprises. Especially specifying policies on land in order to attract foreign investment in Vietnam in the national industrialization, modernization stage, in strongly international economic integration period, in which legal regulations and administration managementof land are considered as drawbacks, even hindering investment activities which require to be overcome.For the above-mentioned reasons, I have studied this topic in order to clarify theoretic bases on state administrative management to foreign direct investment enterprises in land lease; basing on assessment of law and state management of land in foreign investment in general, for foreign direct investment enterprises in particular to identify direction, suggest solutions to complete law on state administrative management. |
