Rural Collective Land Acquisition System Reform In Baota District, Yan’an City

At present, China’s city construction process faster and faster, the expansion of the cityled to a large number of collective land is levied for the state-owned. Because of the defect,collective land expropriation system itself, such as: low standard of compensation,resettlement is unitary and so on, so that damage to the interests of farmers, which causedmany social problems, the social harmony and stability have been seriously affected, at thesame time, this work has also become a focus of social attention."". How to solve problems,resolve conflicts and disputes in the work, to establish what kind of system to protect thelegitimate rights and interests of farmers, is an urgent problem.Discussion based on the above, this paper takes Yan′an City Baota area collective landexpropriation as the research object, through to the pagoda area before2008and after2008the collective land expropriation procedures, compensation standards and social security andother aspects of the situation described, contrast, analysis of the process, from the collectiveland expropriation the problems in two aspects of the legal system and economic interests, toperfect the collective land expropriation procedures, the establishment of a sound socialsecurity and relief system to provide reference.Research shows that: the collective land expropriation completely by the localgovernment and the construction unit (developer), the current land expropriation proceduresto safeguard the legitimate rights and interests of farmers by land acquisition. Incompensation, the compensation standard for land requisition to set to "appropriatecompensation", just think of peasants past input compensation, not considering the futureincome; in the resettlement of farmers whose land has been expropriated, ignoring theproduction, living arrangement, especially the production settlement; in social security, issueda document without investigation and study, field the difficult to implement, and the relatedsecurity system is still not perfect, just stay in the document; in the aspect of social relief, notestablish the relief system, farmers whose land was expropriated in the face of land disputes,can only be reflected through letters and visits, and get in the Bureau for letters and calls ismerely the result of policy interpretation. Because of the market economic environment, toestablish and perfect the collective land expropriation procedures, social security and a seriesof system, improve the land requisition compensation standard, broaden the channels forplacement, maximize the land-expropriated farmers’ legitimate rights and interests, and toconstruct the harmonious society. The main content of this paper is divided into five chapters, the first chapter isintroduction, introduces the research background, purpose and significance, methods andideas; the second chapter focuses on the basic situation of the land expropriation BaotaDistrict of Yan′an City, the collective from land acquisition procedures, compensation andresettlement, social security three aspects of land expropriation, and participate in the maingame analysis; the third chapter finds out the existing problems, and the reasons are analyzed;the fourth chapter on the analysis, the author puts forward the general idea, reform andperfect operation mechanism; the fifth chapter is the conclusion and suggestion part.
