Since1990s, along with the acceleration process of industrialization andurbanization of our country, cause the great demand expansion of urban land, and alarge number of rural collective lands has been subjected by the state. Because ofChina’s current land expropriation system and relevant laws and regulations are notperfect, so that the farmers rights and interests have been infringed upon in the landacquisition process, determine and assign of land acquisition compensation causedlots of disputes and petition in rural areas, and also caused a series of socialproblems, this has seriously affected the social stability. The Party CentralCommittee and the State Council has attached great importance to the rights oflandless peasants and their long-term livelihood. The Third Plenary Session of theeighteen Central Committee of Communist Party of China proposed theestablishment of a fair and open and transparent market rules on《comprehensivelydeepening reform of certain major issue decision》,perfecting mechanism whichmainly determined by the market price, establishing a unified construction landmarket, we must improve the systems and mechanisms, formating new industrialrelations between urban and rural areas to promote agriculture by industry, to thecity with rural, peasants and reciprocity, the integration of urban and rural, themajority of farmers to participate equally in the process of modernization, to sharethe results of modernization. Therefore, study the determination and reasonabledistribution of the land collection with great significance in the new situation.Baotou is the important industrial city of in North China and MongoliaAutonomous Region, with the development of industrialization, urbanization and thestrategy of western development in recent years, Baotou is in the comprehensivedevelopment period, the demand for construction land increased obviously. However, the lack of land resources, the restriction conditions and the fragile ecologicalenvironment resources in Baotou caused the contradiction between land supply anddemand prominently. In the process of non-agricultural use of agricultural land,scientific and reasonable allocations of land expropriation compensation are relatedto the landless farmers’ immediate interests and long-term livelihood.Based on the analysis of the land expropriation and compensation at home andabroad, adopt comparative analysis method, statistical analysis method and theinvestigation method, conduct the empirical research and comprehensive analysis thetypical area of Baotou city from expropriation compensation and expropriationcompensation allocation. Determination of land acquisition compensation for landrequisition, we can conclude the new comprehensive land price increased35%thanthe previous round of the overall. The price of land acquisition compensation areincreased from337.5million yuan per hectare to450million yuan per hectare, theaverage value increased39%in the four districts; The price of landacquisition compensation are increased from28.5million yuan per hectare to58.5million yuan per hectare, the average value increased50%in the five agriculturalareas; The price of land acquisition compensation are increased from1.005millionyuan per hectare to1.44million yuan per hectare, the average value increased18%inthe animal husbandry production area. In addition, due to the higher standard in thelast round of land acquisition, rural new price decreased by21.5%.This shows thatthe overall standard of land compensation of Baotou city is in the middle level, theindividual regional land acquisition compensation standards is lower and placed asingle form. Therefore we can distinguish the public land and non commonweal landon the basis of the natural attributes, social attributes, then integrate them todetermine compensation standards of land expropriation, at last we can get the landacquisition compensation price of Baotou city is higher than the highest standard of land compensation. The average price of expropriation and compensation of thepublic welfare land in Baotou city is: an average of four areas was915million yuanper hectare, five outside counties in the district is750million yuan perhectare, animal husbandry production area is450million yuan per hectare; Theaverage price of expropriation and compensation of non commonweal land expropriationcompensation price is: an average of four areas was1800million yuan per hectare,five outside counties in the district is1200million yuan per hectare, animalhusbandry production area is900million yuan per hectare. In the land acquisitioncompensation distribution, we can solve the unclear "landless farmers" concept、thefuzzy and ratio of distribution object member qualification、the supervision ofdistribution, diversified security needs of landless farmers, in the followingway.We Should make the land compensation and repayment of the principalqualification, allocation and management subject clearly, determine the proportionretained, allocation method, allocation basis reasonably, strengthen supervision andlaw enforcement efforts. The study of this paper provides certain reference for thescientific and reasonable distribution of land expropriation compensation, and alsoprovides experience and reference for other similar types of city land acquisitionsystem reform; both have important realistic significance to realize the sustainabledevelopment and social harmony of Baotou city.
