Research On The Innovation Of Rural Land Contractual Management Right Transfer System

Land is the most fundamental resource to the survival and development of humansociety, which is the foundation of agriculture and the livelihood of peasants, how to makefull use of limited land resources reasonably, to achieve the optimal allocation of landresources, which is the key to solve the problem of "agriculture, rural areas and peasants”.The transfer of rural land contractual management right had been carried on for nearly30years since the middle of1980s. Practice has proved that promote and regulate the transferof rural land contractual management right, which exert a significant influence onlarge-scale operation of land, increasing peasants’ income and promoting the adjustment ofagricultural structure. But there are many defects and deficiencies on the current operationof the land transfer system, such as unreasonable structure of rural land property rights, theimperfect of land right transfers’ market system and supporting measures., which affect hereasonable and orderly transfer of rural land contractual management right seriously.Therefore, strengthen the study of rural land contractual management rights’ problems,improve and innovate the system of rural land contractual management right transfer,which can promote and regulate the transfer of rural land transfer, and ensure the healthydevelopment of Chinese rural economy and rural society stability. It has become aurgent matter.This paper have used literature research, empirical analysis, systems analysis,qualitative and quantitative analysis research methods. Firstly this paper analyze andsummarizes domestic and foreign experts and scholars’ research production about thetransfer of rural land contractual management right. Guided by the theory of propertyrights, rent, economies of scale and institutional changes,this paper have regardedNingguo city in anhui province as the main research object, then elaboratecomprehensively the main characteristics of rural land transfer, the main methods ofgovernment to promote rural land transfer in Ningguo city and the effects of rural landtransfer, and raise some problems. At the same time discusses profoundly the motivatingand restricting factors of rural land transfer in Ningguo city, mainly including internalmotivation and external motivation, internal motivation is mainly manifested in twoaspects, which include the motivation of demand in rural land and supply in rural land.External motivation is affected by the constant improvement of rural land transfer systemand policy, the development of secondary and tertiary industries, urbanization, the promotion of government behavior and collective organization, the influence ofimprovement of education and vocational skills. Restricting factors mainly includes: thedefects in legal system of rural land contractual management right transfer, the lag oftransfer market system, the lower agricultural benefits and the lag of the supporting systemon rural land transfer. At last, on the basis of profound analysis of Ningguo ’presenttransfer situation, this paper put forward some strategies to improve and innovate thesystem of rural land contractual management right transfer, which is to improve the systemof rural land property rights and expropriation, strengthen management and supervision ofrural land transfer, strengthen the supporting and directive policy, improve the transfermarket mechanism, innovative the forms of the farmers interest association and improvesupporting system, with the hope to provide certain theoretical direction to improve thesystem of rural land contractual management right transfer and promote rural land transfer,to achieve agricultural modernization.
