The Research On The Circulation Of Rural Land Contractual Management Right In China

Land is the basic resources that human beings rely on, the basic production materials and the basis for farmers to live. Along with the deepening of coordinate urban and rural development, the accelerating process of agricultural modernization, rural land circulation has became an increasingly common phenomenon. The transferring of rural land contract for the managerial right not only has solved the uncultivated land in rural area and the realistic problems, but also has promoted the appropriate land scale of operation. From the 1980s, due to the implementation of the land contract system and the great number of surplus rural labors transfer, farmers has been beginning to transfer their land spontaneously, and this phenomenon has already begun to take shape now. The circulation of rural land using right has become a difficult problem in the current development of country economy.The circulation of the right to land contractual management not only solve the practical problems in rural areas and other uncultivated land, but also improve land utilization and agricultural production efficiency, accelerating development of rural economy. It is the inevitable trend of economic development. But a lot part of the land is still in the spontaneous style of flow or a disordered state, the peasants of the land contract rights are still constantly being compromised, how to make the land use right transfer toward healthy and orderly development has become the focus of this paper. In this paper, transfer of the right of rural land contracting and management conducted a systematic description, analysis and generalization of the rural land contracting and management right of the flow of factors:the flow of non-standard, land-transfer range of small, single-flow patterns, lack of intermediary organizations, etc. On this basis, this paper analyze the causes of the problem, try to compensate for the inherent nature of the conditions put forward the defects and optimization of external factors related to lack of response, including the improvement of relevant laws and mechanisms, market cultivation, a sound social security system, in the hope of offering scientific basis for improving rural land contractual management right and circulating system.
