The Study On The Contract Of Construction Project And The Settlement Risk

The engineering settlement risk management is an important part of the contractmanagement of construction project, and the claim risk is the main risk engineering contractsettlement faced to. Claim is a proper way to maintain the legal rights of the parties to thecontract and get compensation, but a large of claim affect construction project implementingsmoothly and at the same time, make the final engineering settlement of all the difficulties,and also is a sign of a waste of social resources. Therefore, based on the claim risk thesettlement risk research, provides a new way of thinking to the settlement risk managementfor engineering, and at the same time protects the common rights and interests of the parties tothe contract.This paper, on the basis of the contract risk management for construction project,through the analysis of engineering settlement risk, engineering claim risk, concludes thefeasibility of based on the claims risk to study the settlement risk. On the basis of risk sharingprinciple to both sides of contract, this paper through the risk theory to study the cause andclassification of claim risk, the risk allocation under the conditions of contract and the claimrisk management approach of engineering contract. Then, through the above theoretical basis,it uses the risk factor decomposition identification method and fuzzy analysis method toidentify the engineering claim risk factors and analyze the proportion of every risk factors inthe overall claim risk, and uses fuzzy comprehensive identification method to evaluate theloss degree of various claim incident the risk factors lead to, basis on it sets up the settlementanalysis model, and reflects the claim risk in the final project settlement. Final, this papercombines with Asian tidal channel project, applies this model to an engineering practice, andproves that the settlement analysis model has a certain practicality.
