Research On Overload Of The Coastal Shipping

China’s GDP has surpassed Japan to become the world’s second greatest economies in2014, after the rapid growth of economy for more than30years since Reform and Opening up, China now adds herself to the world economy in a more rational attitude, and the seaborne trade has made undeniable contribution in this process. Since Reform and Opening up, maritime transport has achieved its continuous development, which brings itself a rising status, from the initial service in river trade to global trade, the country has also developed laws, regulations and methods for maritime transport in different environments respectively, which is aiming at promote the healthy development of the industry and is conductive to economic growth. But with the rising status of water transportation, its security problem has become even more prominent, especially accidents caused by overloading and make both ship crashes and people dying once pushes the maritime security issues onto the cusp. Considering the special national conditions, although the formulation of related laws and regulations is being steadily promoted, there are still many aspects inadequate, especially facing with the new situation at present, bad influence caused by overloading is no longer a problem in regulatory levels, containment and reasonable control of the current problem of overloading has now become the hot and difficulty of the guarantee of water transportation safety.Combined with some practices and experience of practical work, this paper reveales the background of overload at the moment, analyzes the reasons of overload of the coastal shipping in a gradual refinement way. Studies are starting from a subjective and objective point of view respectively, combined with theoretical analysis, hazards on water transportation safety and hindrance to the development of the entire shipping are pointed out, new forms of overload at present was analyzed emphatically. Secondly, combined with the general method of determination of overloading in enforcement process, enforcement process and considerations of overload judgment was proposed. Some defects in the enforcement process were found with the further research, rigorous calculation method of and correction method were put forward aiming at quantitative research on overload, the subjective factors in the process of law enforcement weak are expected to be overcomed. Considering that no method is applicable to all environment, decision method under certain circumstance are proposed respectively according to several typical cases, the necessity of this research and the feasibility of this decision method in this paper are confirmed in practical example. Finally, faced with the problems of domestic maritime transport, management experience in related industries both at home and abroad are learned, and pointed suggestions on the management of overload are present, questions are answered from three different aspects:recognization, supervision, and institutional innovation. Consequently, suggestions on the chaos of overload are provided.
