Engineering claim is a basic system that it maintains the legitimate interests of both parties in the construction, which is considered an important criterion to measure the level of the project management of the enterprise as well as the country. This mode was introduced into the domestic project management and achieved good results, but there still exist some problems. The construction projects in current domestic market are very large, so the construction costs and the amount of the claim are also increasing. However, there is few literatures studying the case that there is big divergence between the two sides which may result in the break the engineering claim negotiations. Thus under this circumstances, the wrong choice of the final strategy by the party issuing the contract and the contractor may lead to the expansion and intensity of the conflicts, which results in the lower overall project efficiency. Therefore it is very important to research this case, which plays a very active role in guiding the engineering claim negotiations and the construction of the related system.This study firstly introduced the classification, the processes and the practices of the engineering claim at home and abroad. Based on the brief introduction of the evolutionary game theory, the two parties asymmetric game model was established. In addition, the ESS of the model was analyzed by using copy mode dynamic mechanism. In the meantime, the factors that influenced the choice of the final strategy were analyzed. Then on the basis of the questionnaire, the administrators’choice of the claim negotiations final strategy by the party issuing the contract and the contractor in the construction was surveyed and summarized. Combined with the theoretical findings, the comparison was implemented to analyze the reasons for the same or different results. The suggestions for both the strategy applied by the party issuing the contract and the contractor in the claim negotiations and the construction of the claim negotiations system were proposed. This study provided a theoretical basis for the choice of strategy in the engineering claim negotiations as well as had some guidance for the engineering practice, which also provided a reference for improvement and development of this system.
