With the acceleration of urbanization process in China’s ethnic minority areas, construction activities have become increasingly frequent. In those construction activities, the local governments that have only focused on the development of economic don’t pay attention to the negative effects of construction on tangible cultural heritage, and even choose to give up or sacrifice minorities’ tangible cultural heritage in construction activities, so that minority tangible cultural heritage disappeared in many construction activities. How to protect the minorities’tangible cultural heritage by the legal system in construction activities is an important problem. In this paper, I study this issue by analyzing literature and case, comparative analysis and other methods. I will study the necessity of protecting the tangible cultural heritage from analyzing the sustainable development of minorities, cultural safety, special protection for minority rights and the right to speak point of view. And analyze the legal system of protecting the minority tangible cultural heritage and its defects in our country at present; study people how to affect the implementation of the legal system which protect minorities’ tangible cultural heritage by analyzing case. On the basis of international theory and experience, to clarify all the important aspects of protecting tangible cultural heritage in construction activities. I will make some specific comments about how to protect tangible cultural heritage in ethnic minority areas. For example the participation of minority groups, regulate government behavior and s on. In this paper, I try to explore a suitable way in the protection of tangible cultural heritage.
