In China’s political power structure, the Communist Party of China (CPC) and thePeople’s Congress (PC) are of the most influential political subjects. The relationship betweenthe CPC and the PC is China’s basic political relationship. Proper conception and handle ofthe relationship between these two organizations are crucial, theoretically and practically, todevelop socialist democracy and to build a socialist country under the rule of law. To studythe relationship between the CPC and the PC, it is required to commence from the aspects oflegislative power, decision-making right on major issues, the right of appointment and theright of supervision, focusing on the specific analysis of the relationship between the CPC’spolicy and the PC’s legislation, the CPC’s policy-making and the PC’s decision-making righton major issues, the CPC’s management of cadres and the PC’s right of election andappointment, the CPC’s leading power and the PC’s supervision right. And with respect to themajor problems in these four pairs of relationship, based on the aspect of normalization, theaim of this paper is to study how to fully demonstrate the leading and ruling position of theCPC and to guarantee the specific mechanism and operational procedure exercisedindependently by the PC under the constitution and laws. On the base of normalization of therelation between the CPC and the PC, we can push ahead the transformation of the CPC’sleading and ruling method, strengthen the CPC’s ruling capacity building and the PC’sexercise of the powers as the organ of State, so as to combine the need to uphold the Party’sleadership and to ensure that the people are the masters of the country with the need to rulethe country by law.
