The Research Of Administrative Law Enforcement System

How to improve and perfect the reform of the enforcement of administrative law hasbeen being hardly explored for a long period of time. The administrating and law-executing,which deals with various aspects of the social life, is close to the rights and obligations of theadministrative private party. But there are many problems in the field of enforcement ofadministrative law, such as too many enforcers,implicit responsibilities, overlappingfunctions. These problems is closely related to the imperfections of the administrationenforcement system. The administration enforcement system which is the key and foundationof administrative enforcement. The problem also determines the degree of legaladministration to great extents, and it directly influences and restricts the realization of ourdemocracy’s goals. Therefore,to promote the administration according to law, raise the levelof administrative law enforcement, we need to push forward the reform of the administrativelaw enforcement system.This paper consists of four parts. The first part discusses the system of law-executiontheoretical issues, define the meaning of the administrating and law-executing on the basisconcepts of administrative law enforcement. The law-executing system is the legalization ofbody structure of administrating and law-executing, legal duty and basis of law-executing,law-executing procedure,operating mechanism and internal harmony. The second part mainlyintroduces the current situation of administration enforcement system of food safetysupervision in China and indicates the open questions of administration enforcement system,such as administrative law enforcement body illegal, administrative enforcement authorityunclear division, administrative law enforcement operation mechanism unstandardized. Thethird part introduces the relative experience of the western developed countries and theinspiration to China’s of administration enforcement system as follows: simplify theadministrative law enforcement level,the law enforcement center of gravity down; Improvethe administrative procedures for system; coordinated operation mechanism. The fourth partdiscuss how to perfect the administration enforcement system, from such different aspects as legalization,operation mechanism and supervision of administrative.
