HALAL Food is a kind of food for the nations or people that believe in Islam, which closely connects with Islam.So HALAL food is a specific food which has the largest consumption and also is the most widely distributed. Not only does it have the religious and cultural similarities, but also with regional and ethnic differences. HALAL food is not just Muslim dietary habits of life, and it is also the standard of Muslim social life, religious beliefs and moral behavior.China has always respected the customs of ethnic minorities, and both the Constitution and ethnic regional autonomy have details on respecting for minority religious beliefs, and protection of customs in ethnic minorities lives. In order to better implement the Party and the country’s religious policies, promote social harmony and stability, some control regulations for HALAL food has been developed here and there. HALAL food also is included in the special items of Minority in national laws and regulations. It protects the HALAL diet to a certain extent and makes the implementation of both the country and the party’s national policies and religion policies. However, because there is no unitary national higher-level law, there has been some issues, such as the uncertainty of the standard definition of HALAL food, the usages of HALAL logo, market access, and subject of law enforcement. Because there is no such a national HALAL food industry associations and unified national certification bodies that some producers and operators take advantage of this to make money. They produce and manage lawbreaking HALAL food, so we can see so many Haram food. Not only does it make serious damages to the national feelings between Muslims and brother nations, hinder the creation of a harmonious society, but also hinder the HALAL food to the international market and endanger the diplomacy with the Islamic countries. So what we should do is to develop national HALAL food regulations, establish national HALAL food industry associations, build and improve the certification system, strengthen and improve the supervision systems of HALAL food as soon as possible. It not only effectively protects the nature of "HALAL "of Muslim food, but also embody that our nation and the party respect for national minorities’customs and religious belief. It can promote the economic development in ethnic minority areas, promote national legal system construction, and also reflect the party’s "people-oriented" fundamental purpose.Taking all above as a background, this paper is doing an exploration and research to normalizing the lawbreaking HALAL food. It comprehensively uses theories and research methods in ethnology, law and other disciplines. Through the analysis of the HALAL food market, and based on our existing laws, regulations and policies, this paper has pointed out the current problems in the work, and proposed specific, constructive and feasible recommendations to improve and perfect the HALAL food Law system. This is not only of theoretical significance but also has more practical significance,"people-oriented" fundamental purpose.Taking all above as a background, this paper is doing an exploration and research to normalizing the lawbreaking HALAL food.
