It has always been controversial question in the academic andpractice community that whether polygraph conclusion can enter the fieldof civil litigation and how about its evidence qualification? The earliestusage of polygraph technology as evidence was applied in the field ofcriminal investigation in America, with the development of science andtechnology, it is widely used both in China and abroad. For the shortageof legal regulation about its validity, the polygraph conclusion cannotplay its due role in the field of litigation in the long-term. In order tomake full use of the technical evidence, the author analyses from the legalattribute of polygraph conclusion and the reason why it is treated asevidence, tries to test the usability and value of it.This article is divided into three chapters. At first, it carries on theanalysis from the theoretical properties of polygraph conclusion todiscuss the evidence basis, and then tries to prove the value of polygraphconclusion through the analysis of special cases and finally puts forwardthe conception of polygraph conclusion’s using as independent evidencein civil litigation.The first chapter is a brief introduction of the polygraph andpolygraph conclusion, which mainly explains the origin, process, generalinternational says and scientific analysis of them. The second chapter tries to show us the real cases that how polygraphconclusion is applied in Chinese legal practice and with the help of caseanalysis, it will prove that the polygraph conclusion can be adopted bycivil proceedings and helps to solve some of the problems, finally obtainsthe value of it.The third chapter is to undertake the above argument and propose theidea that polygraph conclusion can be used as independent civil actionevidence and describe the precondition of its application.
