Research On International Legal Issues Of South China Sea And Countermeasures Of China

The South China Sea issue can date from the middle of the last century or later. Itrefers that the sovereignty of the Nansha islands and their adjacent islands triggers aseries of territorial disputes between Southeast Asian and China. Because of itscommanding position and abundant resources, the South China Sea has been being thetarget that the Southeast Asia countries struggle for. In order to grab the interests of theSouth China Sea, Southeast Asian countries attempt to seek improper interests via theSouth China Sea dispute to expand their own territory. In the meantime, the greatpowers outside the region also hope to draw ASEAN countries over to their side tocontain China’s development through the chaos in the South China Sea. With thecorresponding, the international media has spread "the south China sea issue" as hotnews of this year. Due to the internationalization of information dissemination, apolitical issue’s report and spreading affected the international community profoundly.In addition, the public’s understanding and judgment also affected the trend of theissues themselves. The neighboring countries launched a fierce debate on thesovereignty of South China Sea, even to put into force; the situation in the South ChinaSea is being more and more complicated. The great powers, outside of thecontroversial countries, such as America, Japan, India and so on, are scrambling tointervention in the South China Sea dispute, which leads to the south China sea issuestrained and increasingly internationalized.The South China Sea is considered as an integral part of Chinese territory sinceancient times. China has the territorial sovereignty of the Nansha islands and theiradjacent waters, which is undeniable fact. In order to handle the South China Seadisputes properly and defend the territorial sovereignty, China should be combiningwith their own reality, assessing the situation and adjusting the idea of "shelve dispute,common development". Chinese government makes efforts to consult relevant disputesabout the South China Sea with Southeast Asian countries many times, and reached a consensus on the key issues at last. However, the interference of external forces, theSouth China Sea issue is still unfolding and exists.According to the South China Sea dispute international legal analysis, this articleattempts to put forward the methods and strategies to solve the South China Seadispute based on the trend of the South China Sea. This paper includes the introductionand body content of five parts: the introduction section briefly reviewed the topic ofthis paper, the trend of the South China Sea issue and how to make correspondingcountermeasures about the South China Sea situation. The first part of this paper is anoverview of the South China Sea issue, introducing the origin of the South China Seaissue; the importance of the South China Sea issue. The significance of the SouthChina Sea issue in our country. The second part of the article illustrates the southChina sea islands sovereignty belongs to China, through the international legalscrutinizing of the south China sea issue. The third part takes the influence of solvingthe South China Sea issue into consideration, through analysis of the association ofSoutheast Asian nations (ASEAN), analyzing the situation of the South China Sea. Inthis paper, the fourth part studied the development of the South China Sea issue,including the complex evolution of South China Sea, and escalation andinternationalization of the South China Sea issue. The final part of this paper is to solvethe problem of the South China Sea. Facing the complex situation in the south Chinasea, China’s insistence on "the sovereignty belongs to me", a peaceful solution; Adhereto the law, taking the international law effectiveness; From a strategic perspective,dealing with good relations between ASEAN countries; Attaching great importance tothe large countries, such as the U.S. Japan and India and so on; In the cooperationbetween Taiwan and the islands of the south China sea issue; In order to achieve thewin-win purpose, Chinese government should exploit the south China sea resourcesvigorously.
