Research On The Legal Regulation Of Vehicle Number Restrictions

The subject of this thesis----traffic restriction by vehicle tail number, is anadministrative authority of the government imposed on public transportation safetymanagement. With the acceleration of national economy and urbanization, the urbantransportation is getting more complex. As a mandatory administrative measure, vehicletravel restriction plays an importation in coordinating traffic and improve traffic order.However, there still remains some problems to be solved urgently when the restriction isput into practice. This thesis, targeting at the critical problems exist in vehicle restriction,put forward and elaborates on some proposals for the relative laws and regulations.This thesis covers the following five parts:The first part is the introduction to the purpose, significance of the thesis and theexisting studies at home and abroad regarding vehicle restrictions.The second part serves as the guideline to the relative laws and regulations, andalso specifies the concept and necessity of vehicle restriction.The third part lists the shortages of the existing laws and regulations, and theincident consequences and problems.The fourth part proposes some ideas for the relative laws and regulations withregard to the national conditions and the problems in reality, and also put forward somesolutions to the problems as the basic principles for implementing vehicle restrictions.The basic path of laws and regulations include substantive and procedural regulations.The former consists of relative rules improvement and compensation system build;while the latter is made up of a series of systems such as the information system,hearing system and supervision system. These regulations provide certain experienceand reference for future traffic healthy development of China’s control.Last one is the conclusion part, which summarizes the studies included in thisthesis and also the shortages.
