《a theory of justice》 has made the study of political philosophy revived inthe last century70’s,and then, the relationship with Marx theory and justiceproblem has become a hot issue. Before we research the problems of Marx’sjustice,we should first solve the present problem of Marx’s justice,because Marxhadn’t explained his theory of justiceThis paper is to solve the presence of Marx’s concept of justice from twopoints.First, analyze the opening of Marx’s theory of Marx and the justice problemresearch, from the outside with the present. Second, Marx’s historical materialismtheory focus on political economy and it must cross the justice issues inevitably, thispart is from the internal theory to prove justice presence.The concept of justice in Marx’s presence make us research from the perspectiveof justice.This paper starts from the two clues to the study of Marx’s conceptofjustice: one is the obvious criticism, reveals the limitations of speculative justice.Marx was full of justice, but at that time he was the Liberal Conception of justiceinfluence. Dissatisfaction with reality, he reflect the essence of state and law frist.With the in-depth reflection, he found that the separation of the political state andcivil society made the liberal conception of justice limited. The political country triedto transcend the reality of wealth which was caused by human inequality. But civilsociety was still based on private ownership and human alienation, the alienation oflabor was the link between private ownership and personal alienation and private toreinforce each other, economic inequality was extended to every field of social life.Therefore, under the result of Liberal Conception of justice, freedom and equalityare only advocated by equality of historical materialism,the”speculative justiceitself” to “human” practice justice. The theory of historical materialism providespractical justice three viewpoints, the frist two viewpoints are from the values ofsocial history(real part)and the comprehensive development of human (part of it),thelast one is to develop the productive forces, to solve the lack of substance. The fristtwo are the pursuit of people’s freedom and comprehensive development, whichtries to overcome the alienation of man. The last dimension is the realization ofcommunism, which made the justice beyond social reality. The first two to overcomethe justice from the objective and subjective conditions, third degree from theinevitable outcome of historical development rule, to affirm the validity of the firsttwo. The three dimensions of the ultimate goal is to enable the realization of fullhuman equality and freedom. These two clues are linked, but also take care of each other.Marx’s practice view of justice is the critical conception of justice, it started tocriticism from the theoretical and practical aspects, so it will receive theoretical andrealistic response. In the west, Rawls carried the flag under the premise of theoreticalresponse with criticism. Contemporary Chinese combine the conception of justicewith the practical problem of justice, it is also is the response from the realistic angle.This response also make people see the conception of justice in practice three aspectsto the contemporary China has positive implications: one is the design of the systemwill tend to vulnerable groups, the second is the social justice problem to combinethe good aspects of formal justice and substantive justice, the third is the practice ofjustice to develop a human value.
