Research On The Safety Regulation Problems Of Road Transportation Base On The Externality Theory

With the vigorous development of China s road carrying trade, road transportation isdominant in the integrated transport system for its advantages as mobility, flexibility andconvenient. It plays a more and more important role in promoting the rapid growth of thesocial economy, and to meet the needs of people living and producing. At the same time, theexternalities of road transport safety equally widespread attention. Regulation of roadtransport safety departed from the perspective of the public interest, and supervised the entireprocess of road transportation on administration and technology within the legal mandate.However, there also exist externality problem sin government regulations. So, it is become thekey of reform for how to balance the relationship between the government, citizens andthird-party supply enterprises, and how to minimize the negative externalities effect.Since the founding, Chinese road transport safety regulation has undergone three stages:Stringent regulation period, Relax and straighten regulation period and Re regulation period.Outstanding achievements obtained by means such as strengthen legislation, raising thethreshold of entry, and clearing the responsibility of accidents and so on. However, theamount of road traffic accidents still remains high, and caused serious adverse effects to thesociety. Therefore, China should change its road transport safety regulation methods,improving regulatory capacity of government departments to improve the status of roadtransport safety.This article starts from the externality theoretical perspective, combined with economictheory, and using methods combining theoretical analysis and empirical analysis. This articlebased on the sort and summarizes of the domestic and international road transport safetyregulations relevant literature, and comprised the external road transport safety and regulationexternality, combined with our current situation of road transport safety regulation to "metaregulation" theory as a model to build our road transport safety regulation mode.This article also uses the method of comparative study, analysis developed road safetyregulation system and regulation of transport and to learn from examples. Developed roadtransport safety regulation systems provide valuable experiences to us from the legal systemand improve road transport safety emergency systems: we should establish an independentand efficient road transport safety regulatory agencies improve the legal system and strictlyenforce the law, give full play to the role of road transport safety emergency systems and soon.However, we should also be fully aware of the experience of developed countries is not a panacea; we should make a rational choice, and make reasonable position of governmentcombined with Chinese development history, we should improve road transport safetyregulations by perfecting structure and improving system.
