Study On Legal Problems Of Lack Of Credibility Of Charity Organizations In China

Charity has always been an important boost to alleviate social contradictions,stable theconfidence of the people,promote the development of the science and culture of society.However,in recent years,as the frequent occurrence and exposure of various of charityscandal,the credibility of charitable organizations in China fell down.“Guo Meimei incident”in2011has pushed the charitable organizations represented by the Red Cross Society OfChina into the spotlight as never before.The veil of charity was uncovered,bringing peopleincreasing attention and questioning,so the crisis of the charitable organizations in Chinabegan.This article is to “Guo Meimei incident” as the breakthrough point, emphaticallyanalyzing the reasons of lacking credibility of our charitable organizations,and on thisbasis,put forward some improvement suggestions.The article is mainly divided into three parts.The first part,by describing the causes,theprocess,and the social response of “Guo Meimei incident”, is aimed at pointing out the factof lacking incredibility and some obvious problems of the charitable organizations in ourcountry.The second part is about analyzing the legal causes which lead to the lack of thecredibility of the charitable organizations.First of all,from the two aspects include charitylaw classification and the relationship with the government,the undefined legal position ofthe charitable organizations influence its credibility.Secondly,from the point of view that itsinternal management is poor and its charity information transparency is weak,we can findout the problems in the internal management is also the reason for its lackingcredibility.Thirdly,we from the angle of external supervision to analyze the causes.The thirdpart is mainly aimed at the reasons illuminated in the second part,from tree aspects of makeclear the legal position, improve the internal governance and construct the externalsupervision systems of charitable organizations,to discuss the ways to improve and enhancethe credibility of our charitable organizations.
