The Chinese character is the culture embodiment of the Chinese nation. It is a vitalcarrier of Chinese civilization inheritance and development. As a new form of Chinese art inthe digital age, Chinese typeface is also the very culture products with Chinese characteristic.The processing results about Chinese typeface tort case frequently occurred in recent years arenot satisfactory. Academics have debated the legal attribute of Chinese typeface and fontlibrary for a long time. Decisions of court at different levels are multifarious and evencontradictory.The whole typeface and font library industry lack powerful legal protection in China, sothat font industrial environment is very bad, and most of the font enterprises is in the state ofstruggling. Therefore this thesis puts forward the copyright law as a key protection way bycomparing domestic and foreign related legislation and judicial condition, meanwhile theAnti-unfair Competition Law can be a complementary protection mode. So that it may perfectour country’s typeface and font library protection system.First of all, this thesis elaborates legal basis related to typeface and font library, anddefines the meaning as well as corresponding words in foreign material of typeface and fontlibrary. Then it discusses the applicable legal protection modes and their quality in Chinathrough the comparative study the legislation and judicial situation of the internationalconvention and other countries and regions.The whole thesis is divided into the following four chapters:Firstly, the concept of terminology related to typeface and font library. Because thecomputer technology starts late in our country, the suitable concept of Chinese typeface andthe concept of font library is incomplete. So the first part of the article ascertains basicconcepts.Secondly, there are rationality and disorder to protect Chinese typeface and font libraryvia the copyright law. This chapter proves when it reaches a certain degree of originalitywhich meets the requirements of our country’s copyright law; it may be considered as artwork or computer software via analyzing the production process of typeface and font library.In addition, copyright protection accords with the value of justice. It is rational to protect theChinese typeface by copyright law. Thirdly, study of international protection and foreign law about typeface and font library.In order to support the view that Chinese typeface and font library should be protected by law,this part investigates different protection way to typeface mainly by comparativedemonstration. It also expounds Vienna Convention, the sole convention which related withfont protection.Fourthly, the establishment of protection mechanisms for China’s national conditions.This section puts forward the proposal that the Chinese typeface and word library should beincluded in the copyright law as an independent form of works. We must establish suitablecomprehensive protection system whose core is the Copyright Law; besides the Anti-unfairCompetition Law, Tort Law and Criminal Law are important supplements.
