Research On The Copyright Quality And The Legal Protection Of The Computer Typeface And The Computer Font Library

At present, in our country, the cases about the computer typeface and font library of the infringement have occurred, but the law theory and judicial practice on this question does not form a relatively unified solution. For this,the research illustrates that the computer typeface and font library should be protected by the Copyright Law through demonstrating the computer typeface and font library having the quality of copyright, which can not only protect the legitimate interests of the relevant right holders of the computer typeface and font library, but also is conducive to promoting China’s third "the copyright Law" to revise and improve the content, so as to promote the further development of China’s intellectual property system. The main contents of the text are the following:based on clarifying the scientific content of the computer typeface and font library and analyzing the theory of balancing the interests and the labor theory from intellectual property right system, and the specific interpretation of production process and creation of the computer typeface and font library, while making the originality standard of copyright as the content, which proves the computer typeface and font library having the quality of the copyrighted legitimacy. In addition, by comparing and learning the legislation experience and judicial practice from the outside countries in protecting the computer typeface and font library, the research project advocates the establishment of protection system in which the Copyright Law is the core and the Anti-unfair Competition Law, the Tort Liability Law and the Criminal Law is the supplement legislation.
