The small and medium enterprises (SMEs) is the most dynamic market body, and the keypoint of economic growth of China. During the30years of reform and opening up, SMEs hasplayed an irreplaceable role in maintaining stable economic growth, promoting employmentand technology innovation. Since the financial crisis, SMEs has showed it’s weakness of it’scapacity of dealing the crisis because of it’s financial, material resources and manpowerconstraints. However the study of the legal protection of SMEs is not comprehensive enoughand has always focused on the financial problem. While the government procurement(GP), asa national macro-control means, has the policy function of promoting the development ofSMEs, and in recent years,the trend of GP reform has had ti’s main goals on promoting thedevelopment of SMEs.Therefore, through GP to promote the development of SMEs hasbecome a new starting point besides other macroeconomic regulation such as financial andtax supports. Economic law as national economic regulation law, should assume an importantresponsibility to promote the development of SMEs, and to construct a good legal system ofGP to achieve this goal. Domestic and foreign scholars have carried out a series of valuablediscussion on this problem, on the basis of previous research, this paper find a starting pointto improve the government procurement system, combined with the theory of economic lawto promote the development of SMEs and the relevant legislation practice of comparativeabroad, the writer has pointed out the deficiencies of our country’s GP system in promotingthe development of SMEs and put forward the corresponding improvement suggestions.This paper takes “On The Economical Law Protection of SMEs specified in GP” as thetitle, apart from the introduction and concluding remarks,the main body is composed of fiveparts.Part I-Theoretical basis of the GP to promote the development of SMEs. This partreviews the development, functions of GV and the status quo of China’s SMEs, points out therelationship between the policy function of GP to promote the development of SMEs, andcomes to the point of the advantage of extremely necessity of GP to promote the developmentof SMEs. Through this part of the discussion, the main purpose is to show the GP to provide asolid theoretical foundation in economic law to safeguard and promote the development ofSMEs and the advantages as to be discussed below. Part II–Analyse our country’s GP to promote the development of SMEs. This is the corepart of this paper,and the fifth part is based on this part. This part started with the economiclaw (a competitive market and macro-control),provide a all-round, multi-angle discussion ofChina’s current GP system which plays an important role in promoting the development ofSMEs in the function of promoting the development of SMEs and analysis of its deficienciesand reasons.Part III-Experience of developed countries on GP system to promote the developmentof SMEs. This section selected the United States, South Korea, Germany and other developedcountries as representative to explore how their GP system designed to safeguard thedevelopment of SMEs, and summed up what they have in common to guide our legislativepractice.Part IV–Perfection of the system of GP to promote the development of SMEs in China.Against the insufficient of GP in promoting the development of SMEs discussed in the fourthpart, the writer made appropriate suggestions for improvement, including guiding principlesand market competition and government intelligence system.
