Education is the foundation. So the educational level of the relationshipboth determines their own values to achieve and the development of thecountry. The right of education is classified as the third generation ofhuman rights around the world also the Constitution in its provisions forthe citizens of basic rights. Since the Tiantan Constitution Draftstipulates that citizens education obligations for the first time, theright of education has experienced in the history of our Constitution fromcompulsory education to compulsory education, the development ofeducation obligations of the right to education. In1923Constitution ofthe Republic of China to distinguish between the right to freedom andsocial rights, and to expand the scope of civil liberties, and lay a solidfoundation for the affirmation of citizens’ rights in the future. HunanProvincial Constitution, the Constitutional concept of rights-basedfirst proposed compulsory education, although not clearly education free,cannot ensure the implementation of compulsory education, compulsoryeducation, but in the Constitution or the effective promotion of ourcitizens the right to education theory development. Its every advancethat countries respect the fundamental rights of citizens as well as onbehalf of democracy and the rule of law in China continues to improve.
