The author thinks that,only perfect legal supervision system, perfect the supervision mechanism of environmentalsecurity, to ensure the safety of the tailings, can better protect the environment.This article is based on our current tailings pond environmental safety regulatory system,from the legal system and the actual operation level of the carding and analysis, andintroduced the United States, Australia’s national related regulation system, analysis theessence of the system, contact our actual to seek to improve tailings pond environment safetyregulatory system path.The first part of the article from the introduction to the basic situation of the tailings, thetailings are introduced the environmental value and is damaging to the environment,highlights of tailings to the urgency of the regulatory environment in our country. Analyze theenvironmental impact of the tailings pond, through the summary of the environmental issuesthat may arise at different stages of the tailings dam, tailings pond, vegetation, surface waterand groundwater pollution caused by the atmospheric environment, a more serious damfailure after environmental hazards, and finally leads to the necessity of the safety regulatoryenvironment of the tailings dam.The second part mainly aims at our country the current supervision system of tailingscombed and summarized, mainly including legal supervision system and the administrative supervision mechanism. Current tailings pond environmental safety regulatory system isimperfect, the lack of a dedicated the tailings environment safety regulatory basic legislation,rely mainly on administrative rules and regulations to regulate and restrain the tailings pondenvironment, such legislation, the status quo is not conducive to the supervision of theenvironmental protection department the use of power, is likely to lead to the expansion ofadministrative power and conflict. On environment of the tailings safety regulators, is in astate of scattered, duty does not differentiate between various departments, there iscontradiction and blank, and lack of the corresponding coordination mechanism, theenvironment of the tailings safety regulation is difficult to achieve satisfactory effect.The third part is about tailings environmental safety supervision system for foreignintroduction and reference, this paper selected the United States, Australia and Japan, thethree countries tailings, the defects of the current environmental regulatory system, selectreasonable design to provide reference for China’s environmental regulatory system.The last part of the article is aiming at defects of the tailings water environmental safetysupervision system in China, puts forward some perfecting Suggestions. The author intends tobuild from the system to the regulatory environment of the tailings safety supervision system,ideas from a source supervision and process control of tailings, the tailings after the libraryclosed environment after return to work and the tailings dam emergency management system,form a complete legal regulatory system. Second is the introduction of independent oversightin accordance with the system to perfect our country’s environmental regulation mechanism,and supplemented by the social public power of supervision on tailings environmentalmonitoring activities, trying to build an effective and reasonable legal system of environmentof the tailings safety regulation.
