A Research On The Administrative Assistance System In China

Since the reform and opening up, China’s economic construction has made remarkable achievements, but the achievements entails in many problems. For example: the social inequality has increased; the lives of vulnerable groups have faced difficulties increasingly; the distribution of social wealth to benefit the general principles of social development has been damaged; the rights of vulnerable groups to survive the event of infringement have occurred, and the distribution of rights and obligations in China has been imbalanced.In this connection, some issues need to be raised as follows. In the course of the administrative order from the traditional to the modern development of administrative services, administrative authorities should learn how to reallocate social rights and obligations? How to locate the administrative relief system to better protect human rights in the context of building the rule of law?Considering aforementioned problems into account, this thesis will discuss as follows. The first part overviews the administrative assistance system, including the meaning of the administrative assistance, nature, and application of the principle. The second part analyzes the necessity of the sound administrative assistance system, and functional analysis of administrative relief. The third part makes a comparative study of the administrative assistance system abroad, and the development process through the introduction of foreign administrative assistance in order to obtain reference. The fourth part introduces the discussion and reflection of administrative assistance system, including administrative assistance program flow and administrative assistance system problems. The fifth part discusses the countermeasures for the administrative assistance as emerging issues. Subject to the rule of law in China is still inadequate, and the construction of the related research area has not been advanced in depth. As a whole, this paper argues the administrative relief system, and makes some proposals to perfect the related system in China.
