Government public service outsourcing has become an important way to western governments reform since the turn of the century, most of the world countries have transformed their functions from orderly administration to service administration, the government functions expand rapidly. In addition to the burden of traditional functions, the governments also need to provide the public with a large number of public services. Since the1970s, the governments accelerated the development of public services on a global scale, the governments’public service outsourcing is a new way for the governments to provide services, and it has been widely adopted by western countries. Role of the governments has been repositioned during the whole process. The implementation of the government’s public service outsourcing in our country is late. The term "government public service outsourcing" belongs fresh vocabulary.In the1990s, when China was in the era of planned economy, the government was almost "in charge of" all matters everywhere and omnipotent, showing the characteristics of administrative intervention. However, after the reform and opening up, with the construction of a socialist market economic system, the functions of government also changed. The government urgently needs a new way of governance to change status quo of inefficiency, lack of staff, social conflicts etc. during the government is dealing with public services. It makes the rapid rise of the government’s public service outsourcing and accelerated development begins.This paper describes our system of government public service outsourcing, explains the related concept of the government’s public service outsourcing, analyzes Chinese government’s public service outsourcing legal rationale significance of practice, generally introduces the experience of public service outsourcing of the UK, USA, Germany and other major developed country, describes the current situation and problems of the government’s public service outsourcing, summed up the extremely important reference that the experience of western countries’public service outsourcing bring us, proposes the idea of the author to improve the specific measures and legal regulations of our government public service outsourcing. Author believes that the government public service outsourcing must be based on the conditions, and be consistent with the reform of the socialist market economic system. In order to solve the unification mode of the government centralized governance, confirm the positioning of government in the public service outsourcing. We should improve the legal system and institution building, strengthening the government outsourcing contracts, regulatory responsibilities and improve the efficiency of government public services, reduce costs, ensure the rationality and feasibility of the article according to the social development and the economic situation.This paper is divided into seven chapters, the first chapter discusses the background of the framework, research topics, theoretical structure. The second chapter explains the government’s public service associated with the basic concept of outsourcing. The third chapter summed up the practice and era value of government public service outsourcing in our country during the past several decades. The fourth chapter points out the potential risks of the government’s public service outsourcing, not clearly defined, missing of the government’s public service laws and regulations, lack of government public service administration contract, flawed of government public service outsourcing management and supervision. The fifth chapter summarizes the experience of outsourcing of public services research in western countries. Our government may refer to the successful experience of public service outsourcing. The sixth chapter proposed specific measures to improve the government public service outsourcing. The seventh chapter is the conclusion that summarizes the full text and points out the appearing inadequacies in the study.
