Every citizen have the residential right, it is also the premise of other rights and theirown interests,also related to social stability and development of the country. Consideringthe category of the different groups and different people consumption level and otherfactors, the corresponding different housing supply mechanism is established, theexisting commercial housing marketization and dominated by the national policy ofaffordable housing and low-rent housing cannot properly solve the housing difficulties ofthe low-income group, and the existence of the housing cooperatives is an importantapproach to addressing the housing problems of low-income earners.The first part, first of all to define the housing cooperatives, analyze its particularityas the affordable housing supply mechanism. Secondly, comparing the similarities anddifferences between economy applicable room, low-rent housing and commercialhousing and housing cooperatives, constitute a diversified pattern of housing supply.Again,the theoretical basis of housing cooperatives are analysed on the basis oftransaction cost theory, housing cooperatives in the balance of housing seekers andproviders and reduce the information asymmetry problem between with those compete topurchase the housing transaction cost on these two aspects have unique advantages.Basedon the theory of cooperative theory and residence rights protection, housing cooperativeshas the meaning of existence and development.The second part, introducing Germany, Japan and the United States as arepresentative of the relevant system of housing cooperatives abroad, based onintroducing the country specific legislation, legal status of national housing cooperativesabout housing cooperatives, government support, housing property ownership modeevaluate problems such as legislation, in order to offer reference for residentialcooperative legislation in China.The third part,introduce the legislative status quo of housing cooperatives of ourcountry and around the concrete implementation, and analysis in the development of thehousing cooperatives in our country exists some defects and inadequate legislation,suchas the legislative level is low, the house ownership is not clear, the existing law execution,supervision of the lack of vacancy of existence and the lack of government strong support system.The fourth part, put forward corresponding suggestions and countermeasures of ourcountry’s legislation of housing cooperatives based on the analysis of the housingcooperatives and the problems of system.First,to make the housing cooperatives law inorder to improve the legislative level.Second,to combine the ownership and transfer ofhousing cooperatives, house ownership belongs to the membership moreproperly.Furthermore through detailing housing cooperative organization law, strengthenthe execution of existing legal basis and strengthen supervision and the governmentsupport, and set up a more perfect system of housing cooperatives for operation.
