The right to food is a basic human right under the international human right legal system,it is closely related to persons’ survival,health and dignity.Peace and develop are the theme of the world today,after World War II,the international community in general tend to peace and stability, also obtained the rapid development of economy and society, and hunger problems solved in many countries, so to speak.Along with the development of the post-war world economy, the north-south gap is widening, there are still some countries regions in the world of the right to food is not achieved, and both developed countries and developing countries in the practice of the right to food, there are some problems more or less.By2013, the world’s population has surpassed the7billion mark, the rapid growth of the world’s population has seriously affected the sustainable development of human, support more under the existing conditions of the population has become a serious challenge to the international community today.In the international community, the most intimate relations with the hunger problem is food, food is the most basic human survival development condition, but now there are still some residents of the countries and regions by poverty, hunger and the lack of food supply, the absence of their right to food.The universal declaration of human rights, first put forward the appropriate standard of living of including the right to food, the international covenant on economic, social and cultural rights formally established the concept of the right to food, and through a series of documents clarifying the connotation of the right to food and relevant international legal system, the convention on the rights of children and other international legal documents on the right to food international legal system has made some provisions;Some regional law, such as the European social charter, the inter-american additional protocol region made regulation legal system of the right to food,The right to food law more perfect toward countries such as India and South Africa law MinShi property rights make the rules and in accordance with the law to citizen’s right to food have to be addressed by means of judgment;These are to a great extent, realizes the social member’s right to food, promote the development of the world human rights law system.But should also see, the right to food international legal system still has many shortcomings and the insufficiency, in the practice of the right to food supervision mechanism of human rights treaties attaching too much importance to application entity, the provisions of the international legal documents for the right to food is not enough precise, some regions or countries in the international community has not stipulated the right to food, therefore, must perfect the international legal system and implementation mechanism of the right to food.China as a developing country in the30years of reform and opening-up has made the world see the goal achievement, solved the problem of food and clothing of most people, but on the realization of citizen’s right to food, there is a big problem, there is a big defect mechanism of the implementation of the right to food, China must study the realization of the right to food international experience, first of all in law stipulates clearly the concept of the right to food, the implementation mechanism to perfect the relevant system and the right to food, strengthen the social supervision, judicial and law enforcement of the path of realizing the right to food, solve the problem of hunger for food safety and so on in real life.
