Research On Migrant Workers Problem From Social Justice Vision

Migrant workers are not only witnesses and practitioners of China`s reform andopening up but also a special group of China’s economic and social transition. Because ofChina’s modernization drive and its unique path of industrialization, urbanization inChina lags behind the industrialization for a long time, it caused an important resultwhich is the emergence of migrant workers and various social problems associated withit. Such as “Migrant workers failed to get treatment equal to those urban workers”,“thereare big differences between urban residents and migrant workers in employment, socialsecurity, children education, work environment etc.” and “Migrant workers did not enjoyequal treatment as members of society who did not implement ‘decent work’”. All theseare inevitable problem to theory and reality.The social fair problems of migrant workers are not only related to social stabilityand the construction of harmonious society but also building a well-off society in anall-round way. All sectors of society must focus on the protection of the peasant workers’rights and interests, together with realization of the social security. To study the problemof China’s migrant workers from the perspective of social justice, we should start fromthe system construction, establish and perfect the relevant policy system and servicesystem to ensure the system of justice, this is the basic ideas of realizing social justiceand solving the problem of China’s migrant workers.This paper collected relevant literatures, analyzed them and draw lessons from them,as well as those related international and domestic legal knowledge, such as "theconstitution","labor law","social security act" and "the education law", also defined theimportant concepts of this paper to lay the solid theoretical basis for thesis writing. Thisdissertation is divided into three parts.The first part started from the social development and social justice, defines theconcept of social justice, and analyzes the evolution of social development from threeaspects and the relationship between social development and social justice. In the end, itled to the problem of China’s social development and migrant workers.The second part viewed from the reality of China, analyzes the realistic dilemmaand rights of the migrant workers, illustrates there existed binary treatments among urban residents and migrant workers currently in the aspects of employment rights, childreneducation and social security rights. Then concluded that the institutional barriers existedfor a long time are the primary cause of migrant workers problem.The third part explained to ensure the justice depends on the system based on thereport which proposed at the party’s eighteen congress "intensify the system constructionwhich plays an important role in ensuring social fairness and justice, and graduallyestablish social equity and security system which include the main content of fair rights,fair chance and fair regulations." Also analyzed the security effect from the system to fairrights, fair chance and fair regulations and put forward the basic ways to solve theproblem of migrant workers from the view of strengthening the system construction andsystem justice.
