Research On China Insurance Services Trade Legal System

International trade in services as a new type of trade has a rapid development, itsgrowth rate is higher than trade in goods in recent years. In recent years, China’sservice trade is being paid more and more attention. Insurance services trade as part ofservices trade is very important in China’s economy.Therefore, this article tries this level from the legal system to investigate theexistence of insurance services trade issues. For example, if China’s legal system isconsistent with the WTO, China’s insurance legislation liberalizing trade in services,China’s market access for foreign companies in the legal system, China’s insuranceregulatory supervision, and so on. In this paper, the existence of inadequate insuranceservices trade as a starting point, combined with the WTO legal system, makerecommendations to improve the legal system of China’s insurance business, in thehope of China’s legal construction trade in insurance services contribute.Part I: Overview of insurance services trade. From the concept of insuranceservices trade, the current policy of insurance services trade and the world about theprocess of opening trade in insurance services start to lay the foundation for the paperstarted.Part II: the legal system under the WTO mechanism on trade in insurance services.This section first describes the WTO legal documents concerning the organization ofinsurance services trade:"The General Agreement on Trade in Services" and "globalfinancial trade agreement." Then discussed in the "GATS" on several key principlesin trade in insurance services through several key principles to analyze theimplementation of China’s domestic law.Part III: Status Chinese insurance services trade. This section describes the Chineseinsurance services important trade patterns and the current problems of the current.Were elaborated lack of insurance services trade advantages and the existing legal regime, which mainly include issues related to WTO legal documents to adapt, marketaccess and national treatment.Part IV:Insurance services research to improve China trade legal system.
