Study On The Legal Problems Of The Administrative Decision-making In Public Participation

With the rapid ascension of administrative democratization, the public participation becomean important measure of administrative decision-making scientific indicators. This article startfrom the concept of public participation, administrative decision-making, through comparingdifferent continental law system and Anglo-American law system of administrative jurisprudenceto introduce the United States, Britain, Germany, the general situation of the development ofpublic participation in administrative decision-making, to a certain extent of western publicparticipation theory to understand. Then start from the aspects of policy, law, practicesummarizes the development status of public participation in administrative decision-making inour country and introduce the current law in three common form of public participation inadministrative decision-making, and apply on analysis from the perspective of the process isapplication phase of public participation. Analyze the legality and legitimacy, and fundamentallyto support the system of public participation in administrative decision-making in our country.Although our country has been in the practice of public participation in administrativedecision-making related to explore, and made great progress, however, the current publicparticipation in our country administrative decision remains weak consciousness of politicalparticipation, participation main body is not clear, lack of participation is not high, participation,information, and engaging in five aspects such as feedback without problems. According to theabove situation, this article from the perspective of system, put forward the following feasiblemeasures to improve: set up the administrative decision-making democratization, scientificconcept, strengthening the construction of the carrier of public participation in administrativedecision-making, and to establish and perfect the related system of public participation inadministrative decision-making.
