The labor dispatch is a new method of hiring labormarket way, this way of employment, to ease China’s labor marketdemand, to help solve the labor employment. But the labordispatching also has some negative effect. For example,the labordispatch has brought a certain risk to labor dispatchingcompany, employing units and laborers. Because one of thecharacteristics of the labor relations is the short-term, it isinevitable to reduce the quality of employment. Now the labordispatch emergences many problems, especially the damage for rightsand interests of the workers is particularly prominent. China has alarge population, the labor market demands strongly.labordispatching is one of the important components of the development oflabor market, how to regulate the labor dispatching in China hasimportant significance to reduce the contradiction between the workerand the employer unit,and to construct a harmonious society.Labor dispatch in recent years has been rapidly developed inChina and appreciated and supported by many local governments, whichshows that the labor dispatch has its profound foundation and meet theneed of labor market, labor supply and demand sides in a certainextent, especially in support of the reform of state-owned enterprises、promoting flexible employment、organization of surplus rural laborto city and non agriculture the transfer of industry; such a positiverole can not be ignored.The labor dispatching in China shows the positiverole in the following aspects: first, it is to promote the employmentof laid-off workers;secondly, temporary jobs are met;thirdly, labordispatch can meet the temporary labor demand for professionalinstitutions;fourthly,it is to optimize the allocation of talent;fifthly,it is to form the prosperity of the talent market;sixthly,itis beneficial to stabilize the labor environment.At the sight positive effect of the labor dispatch, but also weshould have a clear understanding to the present labordispatch problems in our country. First, the labor right is oftendamaged; secondly, the dispatched employees are ofteninvolved discrimination;thirdly, the informed right of the dispatchedemployees was infringed;fourthly, the social insurance of them can notbe implemented; fifthly,the occupation guarantee right of them are infringed; sixthly,it is difficult to guarantee the relief rightfor labor dispatch employees.Reasons for the above problems, mainly origin the followingaspects:the lack of qualification approval and supervision for laborsending agencies;labor dispatching and use in some state_ownedenterprises and foreign companies are mainstream; unequal pay for equalwork, social security is low; appearing "False foreigncontracting, true dispatching "; the stipulation of “Labor Contract Law”is not clear and refinement,the service levels of thedispatching companies are not professional, uneven,low overall.In view of the above problems,it is necessary to establish andimprove the industry regulatory system,to make the government and therelated agencies give full play,to improve relevant laws andregulations on labor dispatching, to strengthen the supervision of labordispatching agencies,and to promote protection mechanism of rights forthe dispatched personnels.
