| Hunan province is rich in water resources.But it still has some problems like uneven distribution of time and space,seasonal rainfall, heavy pollution and the division of drinking water sources reserve is not scientific.It led to the emergence of drinking water quality is not high and water shortage.many areas appear " afraid to use water "," water can not be used ".If drinking water quality can not be guaranteed to provide compliance with health standards,the amount of water supplied to meet the requirements of the province’s population,it is bound to have a significant impact on social stability, economic development.So,Hunan Province to protect drinking water sources is imperative.Drinking water sources protection law system is to adjust the configuration of drinking water source of the series of the floorboard of the legal norms of social relations.The system from the legal guide people to drinking water sources protection,to prevent water pollution incident occurred,achieve efficient use of water and give full play to the ecological function of water environment. Although our province and cities issued a series of laws and regulations regulations to protect drinking water,like "Xiangjiang river of Hunan province protection regulations","Changsha xiangjiang river reservoir pollution control plan","Liuyang river urban pollution control plan","Xiangjiang river Zhuzhou city drinking water source protection measures for the administration" and "Hunan province Jishou city urban drinking water sources protection regulations".But in the process of protecting drinking water sources,it still there are a lot of difficult problems to be solved.Such as illegal sand mining in the river,poor chemical mining industries are scattered small random pattern has not been a fundamental shift,the processing capacity of environmental protection facilities cannot be adapted to the rapid growth in the development zone,the historical legacy of the severe pollution, etc.Besides,the current drinking water sources protection law system is not perfect,some rules are general,operability is not strong,lagged idea of legislation and so on.It can’t comparing with the seriousness of the public drinking water sources of pollution and the urgency of the protection. Analyze and draw lessons from the United States Japan industrial developed countries, such as drinking water sources protection legal system,according to current situation of drinking water source protection in our province defects and problems,to establish a unified, standardized management rules of the drinking water sources in Hunan province--Drinking water sources protection regulations of Hunan province.This regulation shall apply to all of the drinking water sources in the province of hunan,regulations guiding ideology and basic principle according to the environmental legislation idea of the current,and the concrete system in the existing drinking water sources protection to further improve the legal system.Not only the original applies only to the legal system for protecting drinking water supply in some extended to apply to the province within the scope of the drinking water,but also in some specific aspects has carried on the further added.Specifically,we should take action from the following aspects:(1)The guiding ideology including the source of drinking water for sustainable development, source of drinking water for public welfare and the absolute priority of drinking water sources protection;(2)The basic principles:The basic principles including3parts:The precautionary principle, Safety Principles and The principle of fairness;(3)The specific system, including drinking water source conservation priority system, drinking water source protection areas system, drinking water monitoring system and the source of drinking water emergency disposal system in eight specific system. |
