Legal Regulations On The Supervision Of The Micro-Blog Public Welfare Organizations

At present, our country is experiencing the interim transformation of social development. As a result, a series of social contradiction has produced consequently. For constructing a harmonious society, the lack of social insurance and the disparity between the rich and the poor aggrandizes quite a few puzzles. Due to the morality nature of the public welfare, public utilities play an important role in aspect of poverty alleviation, study assistance and disaster relief and so on. But in recent years, traditional public service organizations come out a series of negative events frequently. These events make the credit standing which general public treat to traditional public utilities reaches to a freezing point. However, with the rapid development of micro blog, a new form of the public service organizations emerges at the right moment——micro blog public welfare organization (MBPWO). Belonging to the mini kindness that the MBPWO advocates, they have assembled quite a few love and kindness in the micro blog and have carried out all kinds of micro blog public welfare activities according to the public wills. Anyway, the MBPWO have introduced a stream of force for evolution of public utilities in our country. As something new, the MBPWO spread so rapidly and manifest advantages and disadvantages consequentially. Currently, the supervision for the MBPWO is in the blank in many aspects, for instance the lack of legislation, the lack of the government regulation, and the lack of self-restraint mechanism of the MBPWO. All of these factors will restrict MBPWO’s tomorrow. To promote our country’s public welfare and the evolution of the MBPWO, the government must primarily strengthen the legal supervision. On the basis of case analysis, qualitative analysis, the writer summarized the current legislative control situation and the main existing problems of the MBPWO. At last the writer also came up with some legislative suggestions.This paper consisted of three sections. The second chapter firstly introduced a case of "free lunch", then cleared the substance of the public welfare, and defined the micro blog public welfare. From the standpoint of sociology and jurisprudence, the second chapter also analyzed the theoretical basis of MBPWO regulation. The third chapter, through the public welfare crisis events which took place in recent years, such as "guo meimei incident"、"the donation being mildewed incident"，generalized the existing problems in the current Chinese public utilities, then analyzed the great potential and existing problems of the MBPWO combined with the mode of the "free lunch". The third chapter also summarized the legal basis and the legislative leak of the MBPWO’s supervision. At last, the fourth chapter put forward some legislative suggestions according to the specific conditions of the MBPWO’s development.
