The frequent occurrence of extreme climate events has made great effect on people’s economic life, and even the energetic construction of a country in recent years. As a result, the issue of climate change has become a global indispensable problem. As a large developing country with a large population, but a low economic lever, how can China consistently improve its abilities to deal with the bad influences on the natural ecosystem and social development made by global warming under the circumstance that international community try their best to slow down global warming? It’s a question that needs to be paid attention to and handled with as soon as possible. Many developed countries have undergone the change from policy to law in the way to explore the climate change. Shall we imitate the models of these developed countries? What kind of legislation system for climate change shall we build up?This thesis has it as the core how to construct the legal system in our country, and analyses the questions we face in the process of making up the laws for climate change, criticizes on some construction features of climate change laws in foreign countries and provides some preliminary imagine of climate change legal system on the basis of analyzing the enforced laws, regulations and departmental rules for the climate change. Apart from that, this thesis also puts forward some suggestions on the solutions for the main problems in the legal system construction of China.The innovation of this thesis is that it analyses the current situation and major existing problems, elaborates some foreign construction features of laws dealing with climate change and the relevant legal system models, images the goals, principle and rules of legislating comprehensive laws for climate change, provides some specific tactics to deal with the problems in legislation immediately for reference.
