Climate change is the most severe challenge faced by human society in 21 st century,meanwhile,it is a global issue that various countries pay close attention to nowadays.With the Paris Agreement coming into force in November 4th,2016,other high contracting parties are confronted with the matter how to amend the domestic law dealing with climate change to work in concert with the agreement,of course,China is not exception.This article mainly expounds the legal countermeasures or suggestions for tackling climate change from the perspective of energy law,which consists of five parts.The first part mainly introduces the relationship between climate change and energy legislation.First,the meaning of climate change is introduced.Secondly,the interaction between climate change and energy utilization is explained.The response to climate change can promote the adjustment of energy utilization structure,and the effective utilization of energy can better solve the problem of climate change.The two parties complement each other.At last,it says three aspects of the commitment,idea advocacy and legal perfection.We should establish and improve the importance of energy legislation for tackling climate change.The second part mainly introduces the current situation of China’s energy legislation on climate change,and explains the frequent legislative activities,especially after the entry into force of the Paris agreement,from the national legislation,local legislation and policy documents respectively.The third part mainly introduces the deficiency of China’s energy law in dealing with climate change,such as the lack of energy basic law,lack of energy management and poor energy regulation,imperfect system and so on,and the lack of special laws of climate change.The fourth part mainly introduces the legal measures and systems of the developed countries,such as the United Kingdom,the United States and Japan,in dealing with the legislation of climate change.Through the study,we can draw some useful experiences for the development of our country and the enlightenment to the construction of a perfect energy law system in China.The fifth part mainly introduces the proposals to improve China’s energy legislation for tackling climate change.The third part is to solve the problems one by one,not only to amend the existing laws.It also needs to improve the specific system and lay a solid foundation for the future energy law.
