Research On The Legal System Of China’s Food Recall

After the emergence of big–headed children, red-hearted egg, and milk with maggot, People not onlyblame the bad behavior of manufacturer but also begin to reflect on the defects of Chinese food safety law,which directly contribute to the implement of food safety law in2009. Although it has been carried out forfive years, the events against food safety are increasing instead of reduce. There are many things stillneeded to be improved, especially food recall system. Now food recall system rules is just a law and is notbeen complied with actually and can’t coordinate the relationship of different department. Things are goingbetter after the food safety law. But the53th of food safety law is to superficial and it can’t be implied inlife. Otherwise, Europe does well in it. Thus my paper object is to learn from, find our shortages, changeour present situation and make our food better.My paper is divided into four parts. The first part is the brief introduction of the theories on food recallsystem. Firstly, the conception and features of food recall system. That’s, recall the unsafety food in marketand do something to make it harmless. Food, as a special food, has something different to othercommodities. By introduce the importance of food recall system on food safety, I get a conclusion thatimprovement of food recall system is necessary.The second part talks about the development process and shortages of Chinese food recall system.China set up this system late. It is considered that the compliance deadline for the recovery of food inJanuary,2002in Beijing marks the beginning of Chinese food recall system. Compared with Europe withdecades of experiences, china is inevitably lack of sound system, which needs to be change in the followingyears.The third part is mainly on the systems executed in Europe nowadays, such as America, Canada,Australia. By analyzing the law systems, regulatory regimes and other supporting systems, I’ll list theexperiences that our country can learn.The fourth part gives some advices on Chinese food recall system. We can do some revolution fromtwo aspects: the systems of food recall laws; the supporting systems. For the first aspect, we can improvethe food recall system, set up regulatory mechanism and increase the punishment to irresponsible producer and the faculties who are in charge of regulatory regimes. The second aspect is the following measures todeal with food recalled flow to market again and technical supports for improving food recall.
