As we know, food really matters to the people. We also know how important the quality and safety of food is. However, with the improvement of science, somehow food processing has become complicated with the increase of food processors and preservatives involved in our daily food quality. Quality and safety has become a growing problem in our society in recent years. How can we forget the impact of some of the cases related to food safety? China witnessed a string of food safety scares. Including the dye Sudan red found in our everyday food (2008). The Shuang Hui group’s denbuterol tainted pork scandal (2010). And the MengNiu event that occurred in (2012). With the increase in cases related to food safety, the public have started to show more interest and concern in these cases than before. It is becoming extremely difficult for people of china to gain access to good quality food. The food recall system can help us solve this problem greatly. Food products found unsafe should not reach the public markets, hence making contaminated food unavailable to the public. This should provide a simple solution to the crisis and protect customer’s interest. The food recall system is different from the consumer protection and product quality law which only comes into effect after the harm is already done to the consumer. The recall system focuses on its ability to prevent rather than cure. In2009"the food safety law of the people’s republic of china" has been adopted and implemented by the standing committee of the national people’s congress. This was a big move after the introduction of "the food recall management regulations"(2007). This move provides china’s food safety supervision mechanism a legal stronghold to rely on. This system also offers a guarantee to perfect the food quality legal system and protects customer’s interests. Because the recall system was implemented rather late, we will encounter some problems for sure, like laws related to sanitation etc, it also seems like the implementing body is not fully functional, also the supervising duty’s and responsibilities are not clear, besides, the food producers lack of social responsibilities and the consumer’s lack of awareness when it comes to their rights. This means that there’s still a lot of work to be done to perfect the recall system and make it stronger. From an economic perspective, the recall system should be researched and compared with the existing legislative laws already being implemented in country’s like the United States, thus indicating our problems with our current system, so they can be improved. This thesis has four chapters, prefaces and summaries:chapter one introduces the fundamental principles of the recall system. Including the origin’s of the recall system, the process and development of its legal position. It’s the theoretical basis for the full text. We should seriously consider using laws like the ones in the United States since they provide plenty of reference point’s for us. In the third part we will analyze the three main reasons why the recall system in our country is very difficult to implement. In the last part, we will indicate the problem in our recall system and how they should be perfected with good advice and concrete measures from the following points:establish a sound legal system. Strengthen the recall system, optimizing and improving relevant supporting mechanisms.
