Research On The Effective Mechanism Of Public Participation In Public Environmental Decision-making

As a kind of the government public policy, public environmental decision-making hassuch characteristics as public, professional and interest-complex. Public participation isplaying a more important role, which will do good to safeguard environmental rights ofpublic. In China, however, most of public environmental decision-making contains nopublic participation. Lack of standardization and institutionalization occurs to be problems.Therefore, how to establish and perfect relevant mechanism to make public participationimplemented properly, fairly and effectively through the entire process of decision-making,will be an issue for government public policy, which needs solving badly.Firstly, public participation, public environmental decision-making and other basicconcepts and theories are discussed and clarified in this article, which definite five aspectsof participation mechanism connotation of public environmental decision-making--theinformation-disclosing mechanism, opinion-expressing mechanism, decision-respondingmechanism, process-supervising mechanism and benefit-connecting mechanism. On thebasis, by the list of public participation types and methods, defects of public participationin China are presented from aspects of the legislative system, administrative system,litigation system and information disclosure. It also comparatively analyses the successfulexperience of public participation in environmental decision-making, pointing out thatonly the establishment of policy could make the public participation works moreefficiently. Taking Foshan city as an example, certain typical case would be analyze, andwhat worth learning would be extracted as well. Finally, based on the domestic andforeign advanced experience, viewing from the angle of preserving public environmentalrights, this article proposed some advices that public participation mechanism ofenvironmental decision-making shall be perfected in aspects of information disclosure,opinion expression, decision response, process supervision and benefit connection, so asto further promote the development of public participation in environmentaldecision-making in China, letting which more scientific, reasonable and sustainable.
