Solutions On The Conflicts Of Natural Person Nationality

It is a strong bond for nationality to contact individuals and nations whichis significant, to both natural persons and nations. Nationality conflicts ofnatural persons occur because of the differences in standards of nationalityidentification in domestic law of different counties. In solving nationalityconflicts, the purpose of international public law is to eliminate nationalityconflicts by constraining domestic law and international treaties, while theinternational private law is to do so by reinforcing the national law. With theacceleration of the social development and the internationalization, the issue ofnationality conflicts is becoming more and more prominent. At the same time,the attitude of the international community towards nationality conflicts haschanged, starting to admit or accept. Nationality Law of People’s Republic ofChina enacted in1980, which adopted single citizenship system, had played afair role in resolving nationality conflicts. However since Chinese economic reform, it barely avoids the conflict and obviously is outdated to a certain extent.Therefore, it is imperative to improve the law attain perfection. This article startsfrom the basic theory of nationality conflicts, then analyzes the cause andmanifestation of the conflicts and explains its solution and legal provisionsfollowed by indication of existing problems of the current law in entry and exitadministration. Through analyzing the international trend of recognizing dualnationality and the two competing opinions in China, it also points out thedisadvantages of recognizing dual nationality in China and offers advices inresolving the conflicts and improving the law.
