Research On Social Support System

With the deepening of the concept of human rights protection and the development of the aging society, the family planning problems once again become the hot topic in society and among the public. At the same time, as the core of family planning policy, social compensation system also arouses a lot of controversy. The conception of "social compensation fee" was born in 2002. Due to regulate the use of natural resources, protect the environment and compensate the funds of government social programs appropriately, the citizens who do not follow the legal conditions to have a child must pay social compensation fee to the government. As the establishment of social support system, the population problem of our country has been solved partly and effectively. Population quality also has been improved. But due to the imperfect legislation, combined with the management in a lot of mess, there are many controversial issues in social support system.This article starts with the specific case of Zhang Yimou. Then it introduces the historical evolution of the support system to explore the rationality of the existence of social support system. And then according to the nature of social support fee, the article puts forward something unreasonable in the content design of the existing social support system. The following puts forward the corresponding improvement suggestions from the aspects of system design and the operation respectively, in order to make social support system play an important role in the society. Finally the paper shows the author’s opinion of the social support system whether to be abolished or not. The basic state policy -family planning policy in China still exists, and the traditional fertility notion, social support system and its existence is reasonable. But the author realizes the social support system is a kind of transitional measures which will weaken and die. What we can do is to insist on and improve the system of social support gradually so that the system design is more scientific and reasonable. In the end, we can make the system truly in practice, and realize the legislative purpose of social support system.The main content of this article is divided into six parts:Introduction:At the beginning it introduces the case of Zhang Yimou, and puts forward the problems exposed in the case according to the social support system.The first part:Introduce the process of the establishment of social support system, and provide some reasons to support the system,such as the relationship between individual reproductive rights and collective right to development, reproductive rights from the individual and the collective right to development, environment right, the legal system.The second part:Introduce the legal nature of social support. Summarize the ideas of the nature of social compensation fee in the present academic circle and practice circle. There are mainly two theories:the "administrative punishment" and "administrative fees". On the basis of the evaluation of the two theories, the author puts forward the views that adhere to the "administrative fees".The third part:On the basis of talking about the nature of social support, this paper analyzes the disadvantages of social support system, such as the collection objects, the collection standard, the collection procedure, leading to the protection of civil rights inadequate.The fourth part:According to the third part which puts forward the unreasonable parts of the social support system.it provides some suggestions to perfect the system respectively from the content of the system design level and operation level.Conclusion:We should continue to adhere to and improve the current system, at the same time, we should realize the system is only a transitional measure, and use a variety of means to realize population control. For example, we can carry through publicity and education, benefit oriented mechanism, combining with the perfect social security system, gradually achieve zero of the social support.
