Study About The Supervision And Restriction Mechanism Of Police Enforcement Power

The police power is represented by public security administration power and investigation power, is one of the power which is closely related with the people. The police enforcement occupies an important position in the whole national law enforcement system. The legality and impartiality of police enforcement are directly related to the stability of society and realization of civil rights and the process of building the rule of law. However, in recent years, non-standard law enforcement, abusing of power, as well as the situation of administrative omission during operation of police power, have caused the people’s and community’s strong reflect, which is not only violating the legitimate rights and interests of social organizations and citizens, affecting the image of the police and authority among the masses, but also severely restricting the police power operating unobstructed. Therefore, it is necessary to strengthen and improve the operation of the police power supervision and controlling. And while ensuring the police power, controlling the police power effectively to prevent the police power abusing and create a good social environment and regulatory environment for the development of market economy is also important. This is the question to be studied in this article.This paper is divided into four sections.The first part is to analysis the background of police power supervision mechanism, and to discuss the current situation of existing monitoring mechanisms. And from the view of legality and the environmental and practical needs to analysis the necessity and urgency to improve the police power supervision mechanism. Meanwhile, this part discusses the significance of supervising to police power from two dimensions of constraints of power and authority protecting.The second part is the theoretical basis for the establishment of Police Power supervision mechanism, including the power(right) restrict and balance theory and holistic governance theory. Power(right) Balance Theory is divided into two part including Separation of powers and Power(right) protection. This theory not only emphasizes the power restriction,but also emphasizes the balance protection of human rights and the exercise of power protection. By introduction of the concept of holistic governance theory, this part is planning to analysis the feasibility that holistic governance mind applies to the supervision mechanism, and pave the way for the following.The third part is to briefly introduce the measure of supervision the approach to the police power running outside the country. Mainly from the fine legislative, reporting system, smooth channels for complaints, strengthening internal oversight to introduce and provide a reference for the perfection of supervision mechanism of police power.The fourth part is the focus of this article, and to explore the improvement of the supervision mechanism of the police power for running. Specifically include the improving the legal regulation and supervision according to law, strengthening the supervision of the integrity awareness, improving the supervision mechanism, integration and coordination of supervision, improving the assessment feedback and accountability mechanisms.
