Research On The Protection And The Realization Route For The Consumer Right To Regret

The introduction of the consumer right to regret, which is a big step forward in the field of consumer protection in our country, become an inevitable outcome of the development of consumer sovereignty thought in China. Regret right as a legal right, which gives the rights of the consumer to get rid of the contract constraints unilaterally without reason, reflects the law of humanistic care. However, the design of regret rights only for a few words of the law, the rough on the legislation, and lacks the corresponding guarantee mechanism, make the right to regret in the maintenance of consumers’ rights and interests on struggling, its effect is poor. therefore, the author wants to analyze the present situation of consumers right to regret, and builds the implementation of the mechanism and security system constructs to ensure consumer regret rights to be implemented, so as to make the operators and consumers can benefit from the consumer regret right system.This paper is divided into three parts besides preface and epilogue:The first part is the basic overview of the right to regret. This part mainly introduces the concept and basic characteristics of our country consumer rights of regret, and comparative analysis of the difference between the consumer regret right system and related systems, finally, expounds the function of the consumer right to regret. Consumer regret right function mainly has three aspects: security freedom means to form, promote healthy competition of the market, broaden the judiciary route. Consumer regret right function implemented can play a huge role in the field of consumer protection.The second part is the plight and implementation path for the consumer right to regret. Focus from practical cases, this chapter analyzes all sorts of obstacles in the concrete operation in the system of regret right, and finally puts forward some superficial to regret right realization of design.The third part consummates our country consumer regret right safeguard mechanism. First of all, we should perfect regret right system to prevent the operator to avoid responsibility and consumer rights abuse; Secondly, the author attempts to build three lines of defense for the consumer regret right, to reach the consumer right to regret of moderate protection.
