At present, research on the new generation of migrant workers problems of domestic scholars mainly from integration into urban society, political participation, identity, social security of peasant-workers, etc. However, rarely of their investigation focus on the cultural spirit. Compared with the old-generation, the new-generation’s cultural demands are much stronger, affective interaction, leisure and entertainment after work, social interaction and personal value realization are the objects of their attention.Culture is a part of city construction in China. To construct the communication channel between the New Generation Migrant Workers and urban residents will be able to achieve the inclusive urban construction better. It is even crucial to state economic development and public security. The New Generation Migrant Workers are the main force to boost growth, whether their cultural rights are protected or not concerns their cultural integration into urban. There for with the constantly increasing cultural and mentally demands of new-generation peasant-workers, it becomes more important for their cultural rights protection.This article conducted field research on the basis of organizing and analyzing the previous literatures, mainly combined questionnaire survey, case method literature review and observational method ways to investigate the New Generation Migrant Workers’cultural rights protection status of 71 workers in the JZL tannery. Through the survey, we found that the new generation migrant workers are entitled to public cultural service resource scarcity, enterprises do not pay enough attention to the cultural rights and interests, the new generation migrant workers’ cultural awareness of rights protection consciousness are weak, and the enthusiasm of participating cultural activities is low. Yet the signs of the new generation migrant workers’ cultural protection are not encouraging. Based on the investigation, the author suggests that reconstruct the new generation migrant workers’ public cultural service system, such as mechanism of legal protection of cultural rights and interests, cultural rights claim mechanism and education and training mechanism from the government, communities, enterprises and the new generation migrant workers.The author hopes that there will be new findings on the cultural rights protection, tries to integrate inclusive development concept into urban cultural construction. To achieve justice and equality between New Generation Migrant Workers and urban residents in the field of cultural rights protection, enjoy equal cultural resources and realize social sharing in terms of cultural achievements.
