A Study On The Construction Of China’s Grassroots Procuratorates

Since the Grass-roots Procuratorate was established, it has been playing an important legal supervision role in the national economic, political and social life. After decades of development, its traditional procuratorial supervision function in criminal procedure and duty crimes investigation function have been basically improved and it has detailed provisions in the terms for handling cases, the procedures for handling cases, rights and obligations of the parties and so no. But as the economic and society develops, and the process of socialist democracy promotes, the state, society and individuals increasingly have high demand for the rule of law, which makes people put forward new and higher requirements to the legal supervision ability and level of Grass-roots Procuratorate. The Grass-roots Procuratorate not only needs do well in criminal supervision and crimes investgation, but also it should develop and improve the supervision ability of other more aspects, such as the ability of the reception of sues and complaints, the ability of procuratorial supervision in civil and administrative litigation, the ability of preventing duty crimes, and the ability of resolving social conflicts and so on. The Grass-roots Procuratorate must meet the demand of the times, all-round, multi-angle strengthen self-construction, improve the level of law enforcement, enhance legal supervision, and maintain social fairness and justice.As the front line of legal supervision, grass-roots procuratorates located in most basic level of the organizational system of procuratorial organs.Whether the party’s policies could be implemented, the procuratorial organs at higher levels could really useful, it depends largely on the grass-roots procuratorates. In this paper, through the investigation on the current situation of the grass-roots procuratorate of Xinzhou City, and combined with the collected literature, I try to dig out achievements and existing problems in the process of construction and development of our grass-roots procuratorates, and put forward some feasible suggestions and opinions, so that the legal supervision of procuratorial organs come true, in order to provide a theoretical basis and practical reference to the reform of the judicial system of our country, achieve the independence of the judiciary truly.This paper is divided into four parts. The first part diccusses the importance of the construction of grass-roots procuratorates from the development of the Chinese socialism, its function、status and role; the second part analyzes the achievements and problems of our country grass-roots procuratorate, in-depth analysis of the reasons e.g. the legal system is not perfect, local management mode restricts the judicial independence, legal supervision is not in place, the team construction is not reasonable; the third part analysis foreign prosecutorial system from the organization system, prosecutors system and funding, so as to provide references for China’s construction of grass-roots procuratorates; the fourth part gives advise on how to strengthen the construction of grass-roots procuratorates, and put forward the author’s point of view.promote grass-roots procuratorate unlocally, to ensure judicial independence; put forward the "public procuratorial work", to realize the "sunshine procuratorial"; strengthen ideological and political construction, and actively carry out the party’s mass line education practice; strengthen the team construction, improve professional level; strengthen the procuratorial work, enhance the level of business; strengthen the construction of standardization.
