Disaster is an indisputable fact that can not be controlled, with the continuous development of the global economic, the links between countries are increasingly strengthened. Cooperation between countries is also increasing. Cooperation between countries of the international disaster relief has become an inevitable social development, assisting to the victims reflects the progress of human civilization. Legal status on international disaster relief personnel in disaster affected state is different because of their types of body. International and regional legal documents have been to try to solve these problems effectively.This paper is divided into five aspects.Chapter 1:the related concepts and definitions. This chapter is divided into two parts. The first part is the meaning of the disaster and disaster relief, analyzing the meaning of the disaster and disaster relief from various legal documents. The second part is the concept and function of International disaster relief personnel.Chapter 2:International disaster relief personnel are difficult to be recognized in international disaster response law. This chapter is divided into five parts. The first part is that humanitarian assistance organizations’ creating law function is restricted. The second part is that the role of non-governmental organizations in international disaster relief is not valued. The third part is that non-governmental organizations’ legal personality is not recognized. The fourth part is that non-governmental organizations and affected state’s communication manner is unclear. The fifth part is the development and limitation of non-governmental organizations in international disaster response law in China.Chapter 3:the main problems that the International disaster relief personnel mat in international disaster relief practice. This chapter is divided into two parts. The first part is the training of International disaster relief personnel. The content includes the legal background and main problems in disaster relief training. The second part is coordination problems. The content includes legal obstacles and actual operation in coordination.Chapter 4:legal facilities for qualified International disaster relief personnel. This chapter is divided into four parts. The first part clarifies the meaning of qualified International disaster relief personnel. The second part is visa and recognition of professional qualification. This part expounds mainly from the following aspects, the problems of visa and recognition of professional qualification in affected countries, the complete measures of visa and recognition of professional qualification in china. The third part is the security and freedom of International disaster relief personnel. The fourth part is the legal behavior ability of International disaster relief personnel in disaster affected state.Chapter 5:the legislative analysis of legal status on international disaster relief personnel in china. This chapter is divided into two parts.
