A Research Of Protecting County Financial Consumer’s Rights And Interests

In recent years, the global economy sustained and rapid development, people’s wealth has been accumulated quickly, financial consumption demand is increasing. But compared to the general market transactions, financial transactions are very special, such as financial products are highly professional and complexity,there is information asymmetry on both sides, all of this caused the rights and interests of financial consumers are damaging. Since the middle of the last century, western developed countries has began to pay close attention to the financial consumers’ rights and interests protection,and after a series of practical efforts to form a powerful protection for financial consumer rights and interests protection.Since the reform and opening, our country finance has achieved rapid development, financial supervision and macro-control level are in constant ascension. But the financial consumers’ rights and interests protection is basic at the blank stage, no matter in the construction of legal system, administrative regulatory framework construction and financial knowledge are the relative lack. Especially in county area, because the people of the county lack of correct cognition and understanding for financial risk, financial markets, financial institutions and financial products, county financial competition is not sufficient, these series of reasons have led to the damage for the county financial consumer rights and interests particularly serious, and because of county financial consumers lack of corresponding legal awareness, rights of way in the county area is not smooth, which makes it hard to get reasonable compensation for damage of county financial consumer rights and interests.Based on the above background, this paper carried out study for county regional financial consumer rights and interests protection. The article first summarize the views for financial consumer rights and interests protection of the domestic and foreign scholars,then this paper analyzed the related theory of the financial consumers’ rights and interests protection.Based on practice for financial consumers’ rights and interests protection in Britain, the United States, Japan and other developed countries, this paper analyzed the present situation of county financial consumers’ rights and interests protection,and further points out that the major cause of county financial consumers have been damaged: county financial consumers lack of financial knowledge, lack of administrative regulatory agencies and dispute settlement mechanism is not sound.In the end the paper put forward a package of counter measures: the top level legal system construction, the financial administrative regulatory agencies to build and strengthen financial consumer education and establish effective dispute resolution mechanism, so as to providing comprehensive protection for country financial consumers’ rights and interests.
