The paper studies the influences that IPR has on Chinese technology improvement and export trade structure and different industries being distinguished by technology levels. This paper first reviews previous studies on the structure of exports expressed in trade relations with the protection of intellectual property, sorting out relationship between the two points. Secondly, the paper analysis effects of intellectual property protection through different paths and technological levels of products by using economic theory. Protection of intellectual property impacts technological advances in the way of technology transfer and technology creation, then the advancing technology changes competitive strength and structure of exporting production. The high-technology part is more sensitive to this.In the empirical part, the paper selects GP index as an indicator measuring the level of IPR protection, and amends the indicators of developing countries using HL index, calculating the levels of China IPR protection between 1996 and 2013. Then the paper analyses the structure of export using Lall classification, calculating the revealed comparative advantage index of different technological content of products of China in 2001-2012, and describes the status of export trade structure in China.Next, this paper selects six major countries, calculating their IPR protection levels and revealed comparative advantage index of different technological content of products in 1996-2012,finding that raising the level of IPR protection will help to improve the structure of export trade. In the last part, by using Chinese data, the paper selects the competitiveness of the export products of several industries as a representative of export trade structure. Then it establishes a correspondence between industry data with export products, referring to position in value chain, dividing the selected 22 industries into three parts according to classification of Lall, to establish econometric models. The empirical results show the conclusion that IPR protection level has different impacts on dissimilar technology-intensive products. At last, this paper, on the basis of conclusion and current situation of China, gives policy recommendations that actions should be taken to improve export structure by realizing the ways IPR protection works and different effects on products, including refining IPR protection, perfecting laws and encouraging innovations.
