An Study On The Governance Of Urban Illegal Construction And Its Governance

Illegal construction is one of the common problems in the process of urbanization.Illegal construction in the legal sense means the construction without a building permit or violate the content of building permit.However,illegal construction in the social sense not only includes the above illegal construction and illegal land use,but also includes the constructions that need to be demolished.The existence of a large number of illegal construction has seriously affected urban development.It causes a lot of problems,such as reducing the credibility of the government,affecting urban planning,causing potential safety hazards,disturbing market order,destroying the city appearance and environment,affecting social stability,increasing social costs and so on.In order to solve these problems,Guangzhou and other major cities in China have continued to explore effective means to deal with illegal construction.Then them encountered many difficulties,mainly including the non-uniform application of legal standards in administrative law enforcement,the uncoordinated handling mechanism of illegal construction,the lack of initiative of the investigation and punishment subject,the complex and long investigation and punishment procedures,the difficulty in the approval of legal construction,the imperfect reform of the comprehensive law enforcement system of streets and towns,the limited legal deterrence,the pattern of social supervision and governance has not been formed.We should perfect the legal system from coordinating of laws related to illegal construction and governance,building a "big comprehensive law enforcement" mechanism in combination with reality,Comprehensively improving the executive power of the main body of investigation and punishment,simplifying the investigation and punishment process of illegal construction,reasonably adapting the approval system of illegal construction,exploring and improving the comprehensive law enforcement mechanism of streets and towns,improving the illegal construction cost of the parties,and building a multi-level social governance pattern.Finally we would improve China’s illegal construction governance system and urban and rural planning system.
