A Study On China’s Community Correction

At present,the execution style has gradually entered into the lenient era.Along with the improving,the community correction system of the western developed countries it has already become a kind of widely adopted penalty by many countries and regions.The community correction, is to fully explore the various resources of the community.to meet the conditions of community corrections perpetrators of crime, through the implementation of transformation, probation and education, in order to punish crime and criminal psychological correction for the purpose of non imprisonment penalty.Nowadays our country is gradually explore the local Penalty systemAlthough in recent years, our country introduced the relevant laws to regulate the specific work of community correction,butthe existing laws and regulations are still not practical to reach the community correction work. There are still defects in the application of community correction, community correction execution, supervision and so on,need to improve relevant legislation, to ensure the implementation of community correction.The paper is based on this backgrounding the methods of comparative analysis and empirical analysis,research the present situation and the problems of our community correction work,to improve our country’s social ideas suggested of community correction system.The paper consists of five parts:The first part:the basic theoretical issues of community correction.On the theoretical basis, the concept of community correction,characteristic properties are introduced in this part.The second part:the formation and development of the community correction system. Use of theoretical analysis to comparison on the America, British,Japan’s community correction form the present situation and development.The third part:analysis of the history, status and characteristics of community correction in China.This part discusses the historical origin of community correction in China as well as the community pilot status and legal basis.The fourth part:the problems of community correction in China.research the main mode of our community correction and analyzes five problems of the community system correction: suitable number of community correction is less; the social identity of community correction are low; "strike hard" policy on the adverse effects of community correction; funds can not guarantee; construction of community correction work force needs to be improved.The fifth part:the suggestions of improving the community correction system.Based on our community correction system problems,From the perfect community correction legal system, to explore the scientific community correction measures, and create a new pattern of legal supervision of community correction, establish professional community correction work team to our community correction system recommendations.
